Parking fine at Sainsbury's, Benton Road, High Heaton
On 17th April 2009 the Evening Chronicle reported a story about a fundraiser who was setting up a charity stall at Sainsbury's in High Heaton. She parked her car in a disabled parking bay while she unloaded her car. Whilst unloading she was issued with a ticket by a company called Disabled Parking Enforcement.
Whilst we do not condone parking in disabled parking bays, this case is unusual because Sainsbury's store manager said that the supermarket were not aware of this parking company operating on it's land and that they had not given this or any other private parking company authority to operate on its land.
In this type of case there has been no breach of contract as the contract can only be formed between the landowner (or its agents) and the motorist. As Disabled Parking Enforcement were neither the land owner or agents for the land owner the fine is not enforcable.
